You appointed us to inquire into ways and means of establishing a structure of salaries, conditions of service and related benefits for the Judiciary, separately from the Civil Service. In carrying out this task, we reviewed the important role of the Judiciary, the challenges it faces and its contribution to the administration of justice in Kenya. We also reviewed the present state of the Judiciary in terms of structure, organization, resources and its capacity to meet these challenges. Consequently, we have recommended appropriate adjustments in these areas to enhance that capacity. We have further recommended a structure of salaries and other terms and conditions of service which we consider appropriate. We have also recommended that para-legal staff should be absorbed into the Judicial Department and be employed by the Judicial Service Commission. In our work, we have been highly motivated by Your Excellency's desire for the enhancement of the capacity of the Judiciary to deliver justice to the public in a fair impartial and responsible manner which would engender public confidence in the Judiciary. We take the greatest pleasure in submitting this Report to your Excellency and in doing so, we wish humbly, to express our sincere gratitude for the honour and trust that Your Excellency has placed on us and to express our loyalty and highest esteem.
